Overview

Welcome to Little Apiary on the Prairie. Throughout this document, “we,” “us,” and “our” refer to Little Apiary on the Prairie (DMR Enterprises, LLC). These Terms of Service (“Terms”) govern your access to and use of our website and online store, including all products, content, and services we offer (the “Services”). Our store is hosted on Shopify, Inc.

By visiting, browsing, or purchasing from our store, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Section 1 — Account and Access

By using the Services, you confirm that you are at least the age of majority in your state of residence, or that you have consent from a parent or guardian. You are responsible for the accuracy of all information you provide and for maintaining the security of your account credentials. Accounts may not be transferred or assigned.

Section 2 — Products

We make every effort to represent our products accurately. Colors and appearance may vary by device. We do not warrant that product quality will meet your expectations or match on-screen depictions exactly. Product descriptions, availability, and pricing are subject to change without notice. We reserve the right to limit quantities or discontinue any product at any time.

Section 3 — Orders

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. Orders are not accepted until we confirm and receive payment. Please review your order carefully before submitting—cancellations may not be accommodated after acceptance. All purchases are subject to our Refund, Replacement & Pickup Policy.

Section 4 — Prices and Billing

Prices are subject to change without notice. The price charged will be the price in effect when your order is placed. Posted prices do not include applicable taxes. You agree to provide accurate, current billing and payment information and authorize us to charge your payment method for all amounts due.

Section 5 — Pickup Schedule and Delivery

All published pickup times and windows are estimates. We transport live animals over multi-state routes spanning hundreds of miles. Exact arrival times at any stop may be affected by weather, road conditions, traffic, mechanical issues, livestock-related delays at prior stops, or other circumstances beyond our control.

We make every effort to communicate delays promptly by email and at littleapiaryontheprairie.com. However, we cannot guarantee arrival at any pickup location at a specific time, and we are not liable for losses, costs, damages, or inconvenience resulting from schedule changes or delays inherent to the transport of live animals.

Section 6 — Live Goods Acknowledgment

Bees are live agricultural animals. Their survival depends on prompt pickup, proper handling, installation, feeding, hive placement, and ongoing management by the customer. By placing an order, you acknowledge that:

• A percentage of bee losses is normal in beekeeping at every level of skill and is not by itself evidence of a defective product.

• Once you take possession of bees at the pickup site, their welfare is your responsibility.

• Live-goods claims are governed by the timelines, evidence requirements, and remedies in our Refund, Replacement & Pickup Policy, which is incorporated into these Terms by reference.

• We make no warranty, express or implied, regarding the future productivity, honey yield, overwintering success, or longevity of any bees we sell.

Section 7 — Pickup Obligations and Communication

All pickup details, schedule changes, and time adjustments are communicated by email to the address on your order and posted at littleapiaryontheprairie.com. You agree that:

• You will monitor the email address on your order, including spam and promotions folders, in the weeks leading up to your pickup window.

• You will check the website for schedule updates and weather-related changes.

• Failure to receive or read our communications is not grounds for any refund, credit, or replacement.

• Bees not picked up within the scheduled window are forfeit, as described in the Refund, Replacement & Pickup Policy.

You acknowledge that you have read and agree to the Refund, Replacement & Pickup Policy, including its reporting windows, evidence requirements, and remedies. Any claim must be submitted strictly in accordance with that policy and within the timeframes it specifies.

Section 8 — Intellectual Property

All content on the Services—including text, images, graphics, logos, and designs—is owned by Little Apiary on the Prairie or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from the Services for commercial purposes without our prior written consent.

Section 9 — Third-Party Links and Tools

The Services may include links to third-party websites or optional tools we do not control. We are not responsible for the content, accuracy, or practices of any third party. Use of third-party tools is at your own risk. Any complaints or questions about third-party products should be directed to the third party.

Section 10 — Relationship with Shopify

Our store is powered by Shopify, Inc. All sales are made directly with Little Apiary on the Prairie. Shopify is not responsible for any aspect of transactions between you and us, including any injury, damage, or loss from purchased products. You release Shopify and its affiliates from all claims arising from your purchases.

Section 11 — Privacy

All personal information collected through the Services is subject to our Privacy Policy [LINK]. By using the Services, you consent to the collection and use of your information as described in that policy. Because our store is hosted by Shopify, certain data is also subject to Shopify’s Privacy Policy.

Section 12 — Feedback and User Submissions

By submitting ideas, reviews, or other content to us, you grant Little Apiary on the Prairie a perpetual, royalty-free license to use, reproduce, and distribute that content for any purpose. You represent that you own or have rights to any content you submit and that it does not violate any third-party rights. We may remove any submission we determine to be unlawful or objectionable.

Section 13 — Errors and Omissions

We reserve the right to correct typographical errors, inaccuracies, or omissions in pricing, product descriptions, or availability at any time without prior notice, including after an order is submitted.

Section 14 — Prohibited Uses

You may use the Services only for lawful purposes. You may not use the Services to: violate any law or regulation; infringe intellectual property rights; transmit malicious code; collect personal information of others without consent; harass, defame, or harm any person; or interfere with the security or operation of the Services. We reserve the right to terminate access for any violation.

Section 15 — Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Section 16 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LITTLE APIARY ON THE PRAIRIE, ITS OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES—INCLUDING LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS—ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Section 17 — Indemnification

You agree to indemnify and hold harmless Little Apiary on the Prairie, Shopify, and their respective officers, employees, and agents from any claims, damages, or expenses—including reasonable attorneys’ fees—arising from your breach of these Terms, your violation of any law, or your use of the Services.

Section 18 — Termination

We may terminate or suspend your access to the Services at any time, without notice, for any violation of these Terms. Provisions that by their nature should survive termination—including intellectual property, disclaimer of warranties, limitation of liability, and indemnification—will remain in effect.

Section 19 — General Provisions

Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

Waiver: Our failure to enforce any provision does not waive our right to enforce it later.

Entire Agreement: These Terms, together with our Privacy Policy and Refund, Replacement & Pickup Policy, constitute the entire agreement between you and Little Apiary on the Prairie.

Assignment: You may not assign your rights under these Terms. We may assign ours without notice.

Governing Law: These Terms are governed by the laws of the State of North Dakota. You consent to jurisdiction in the courts of North Dakota.

Changes: We may update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance.
